TERMS AND CONDITIONS
When placing an order with KBT Treats (hereinafter “we”, “us”, “our”, “KBT Treats”), you (hereinafter “you”, “your”, “customer”, “client”) agree to the following terms and conditions:
DUE TO SUPPLY AND DEMAND OF CERTAIN INGREDIENTS/SUPPLIES, PRICES CAN FLUCTUATE THROUGHOUT THE YEAR WITHOUT NOTICE, PRIOR TO PLACING YOUR ORDER
PREPARATION All goods purchased from KBT Treats are made-to-order. Orders can take several days to plan and prepare, depending on the complexity of the details, and availability of specific supplies/materials. Be mindful of this and place your order well in advance.
ALLERGY DISCLAIMER Please be advised that our products may contain or have come in contact with eggs and egg by-products, peanuts, tree nuts, nut by-products, milk, dairy products, wheat, gluten, coconut, soy, cocoa, sesame, or an allergen not listed. Although we follow essential sanitation practices to keep our prep area clean and avoid inadvertent allergen cross contamination, we can’t guarantee a total absence of allergens in the goods we produce. It is your responsibility to inform your guests of this risk. KBT Treats is not liable for any allergic reactions that may occur as a result of trace elements coming in contact with products consumed from our bakery.
ORDER CONFIRMATION Your order will NOT be placed on our calendar or considered “booked” until either a 50% NON-REFUNDABLE AND NON-TRANSFERABLE deposit (orders over $200) or payment in full (orders under $200) has been made.

PAYMENT METHODS We accept cash and, via invoice, all major credit and debit cards, Zelle, Venmo, and Cash App.
DEPOSITS Orders over $200 require a 50% NON-REFUNDABLE AND NON -TRANSFERABLE deposit that must be paid within 48 hours of the invoice date. The remaining balance must then be paid on or before the due date located on the invoice. If no deposit is paid within 48 hours of the invoice date, your invoice will be canceled. If you request to have the invoice resent, you will be charged a $10 service fee that must be paid prior to the invoice being resent. If the remaining balance is not paid on or before the due date located on your invoice, your order will be canceled, and your deposit will be forfeited. KBT Treats is not liable for any loss to you caused by nonpayment of the remaining balance on/before the due date. If you attempt to pay the invoice after the due date, you will be charged a fee of 20% of your order total. We reserve the right to refuse payment, and NO refund or store credit will be given. Payment of the invoice represents your acceptance of all order details.
FULL PAYMENTS Orders under $200 require payment in full within 48 hours of the invoice date. If payment is not made within 48 hours of the invoice date, your invoice will be canceled. If you request to have the invoice resent, you will be charged a $10 service fee that must be paid prior to the invoice being resent. NO refund will be given once payment has been received. Payment of the invoice represents your acceptance of all order details.
CUSTOM CAKES Custom cakes require a three week notice. Although we will make every effort to follow your request closely to create the design you desire, we will not copy another cake artist’s work exactly. Therefore, our creation will not be a replica of the photo or inspirational sketch provided to us. We reserve the right to exercise our artistic abilities and interpretation while still keeping the integrity of the cake’s overall look, as well as considering the structural needs. Cakes that involve dark reds, vibrant blues, blacks, and violet tones can potentially stain teeth or clothing, and possibly affect the cake’s flavor. KBT Treats is not liable for any issues resulting from your choice of colors. All cakes with four layers or more than one tier will contain dowels to assist with the cake’s stability and should NOT be used as smash cakes. KBT Treats is not liable for any injuries resulting from cakes being smashed in someone’s face.
Refrigerated cakes should be kept out at room temperature for at least one hour prior to serving. Keep in mind that the variety in temperature and humidity may, to some degree, impact the texture or overall design of the cake. KBT Treats is not responsible for changes of any kind to the cake (or any products) due to temperature or unfavorable weather conditions.
Leftover cake can be cut into individual slices or kept whole, wrapped in plastic wrap or aluminum foil, placed inside an airtight container, and stored in the refrigerator for 5-7 days or frozen for 3 months. Allow cake to come to room temperature. (I personally have had a whole top tier 6” cake which was wrapped and stored in the freezer for a year and was just as delicious as the day I cut slices from the other two tiers).
SHORT NOTICE ORDERS We may be able to accommodate a short notice order, if we have availability, and depending on the complexity of the order. Payment in full may be due at the time of ordering and a rush order fee will be applied. Failure to pay by the due date on your invoice will result in your invoice being canceled. If you request to have the invoice resent, you will be charged a $15 service fee that must be paid prior to the invoice being resent. NO refund will be given once payment has been received. Payment of the invoice represents your acceptance of all order details.
ORDER CHANGES You may request certain changes to your order 10 or more days prior to your pick up/delivery date. Although we will make every effort to honor your request, we can’t guarantee that all changes would be possible. Therefore, it is very important to check all details of your design before placing your order. Changes may result in an increase to the quoted price and are also subject to a design change fee. NO refund or credit will be given on items purchased for the original design but may no longer be needed. Those items become the property of KBT Treats. NO refund or credit will be given on requests to downsize your order.
DATE CHANGE If, for any reason, you need to change your event date, contact us immediately. Accommodations are subject to our availability and whether enough notice was provided. NO refund will be given due to our unavailability to accommodate your new date. If we are unavailable for your new date, you may choose to receive your order on the original date and freeze for future enjoyment or receive store credit, minus 15%. The total amount of store credit must be redeemed within 60 days of the original event date. Credit not redeemed within 60 days of the original event date will be forfeited. If the design for the future order is different from the original design, no refund or credit will be given on items purchased that would no longer be needed. Those items become property of KBT Treats. NO refund will be given if you request to downsize your order, and any upgrades will result in an increase in price. KBT Treats is not liable for any loss to you caused by our unavailability to accommodate your new event date.
CANCELLATION POLICY To receive store credit, orders requiring a 3 week notice must be canceled 10 days prior to the order due date and orders requiring a 2 week notice must be canceled 7 days prior to the order due date. Store credit is subject to deductions such as ingredient costs, items purchased, and research/planning time that will be determined on an individual basis. Orders placed within the specified time will receive store credit of 50% or less of the total order, to be determined by the amount of work already completed and determined on an individual basis. All store credit given must be redeemed within 60 days of the original order due date. If the customer cancels, KBT Treats is not responsible for any loss or consequential loss incurred by the customer as a result.
REFUND POLICY All fees paid to KBT Treats are NON-REFUNDABLE and under NO circumstance will any product be exchangeable. However, if KBT Treats has to cancel your order for any unforeseeable reason including, but not limited to, a severe medical condition, injury or accident of any kind, pandemic, NCD, illness, immediate family emergency, or death, you will be issued a full refund of all monies paid to us. Otherwise, all refunds given per our discretion will be in the form of store credit.
We take great pride in providing quality products to our customers. We bake our cakes from scratch and taste our products to ensure quality. Refunds requested due to dislike of flavor or texture will be at the sole discretion of KBT Treats, because cake flavor and texture is very subjective. If you deem a product sub-par, it must be brought back within 24 hours for examination. You may be eligible for store credit if the flavor or texture is determined not to meet our standard of quality. No refund requests for decorating style, color, shade, or any general decoration design will be honored.
PICK UP KBT Treats is a licensed commercial bakery located on private property and, therefore, not open to the public. Customers pick up their order at a location that is central to the areas we service. This address as well as your pick up time will be located on your invoice. We suggest that you GPS the address prior to your pick up date to become familiar with the location, in order to arrive on time. However, we understand things happen that may be uncontrollable, therefore, we allow a 15 minute grace period to pick up your order. (If any unforeseen circumstances occur, please contact us immediately). Otherwise, after 15 minutes, your order will be returned to the bakery, and you will be given a new pick up time based on our availability. A $25 redelivery fee must be paid prior to us leaving the bakery to redeliver your order. Failure to pay the redelivery fee will result in your order being canceled. NO refund or credit for a future order will be given.
Once the customer leaves the premises of the pick up location, the order is considered to be “accepted” and becomes the responsibility of the customer. Cakes can be fragile and easily damaged if not handled properly, so when possible, cakes should be placed on the floorboard and the temperature inside vehicles should be cold. NO cakes or any product containing frosting, fondant, or chocolate should ever be placed in vehicles facing the sun. Also keep in mind that outdoor environments are less suitable for cakes and may expose cakes to insects, unfavorable weather, or debris. KBT Treats is not responsible for any damages occurring to any products during transport, set-up, or any time thereafter. KBT Treats is not liable for damage on a cake that is displayed outdoors since natural outdoor conditions such as heat, humidity, or un-level ground can weaken or ruin the infrastructure and/or decorations on the cake.
It is your responsibility to make sure guests, especially children, do not pull items from the cake and consume. It is your responsibility to remove all edible and nonedible items from the cake prior to it being cut and served. Some items are made from edible materials but are not intended for consumption. Some edible items may contain wires, toothpicks, or skewers which are added to provide flexibility and/or secure their position on the cake. KBT Treats is not responsible for anyone’s consumption of edible/nonedible items or any harm/injury that may occur as a result of doing so.
DELIVERY Delivery options are available within 20 miles for orders over $300, for a fee of $20 and subject to our availability. You agree to provide clear driving directions, and advise KBT Treats of any adverse road hazards and/or obstacles that could potentially cause damage to your cake (including, but not limited to steep hills, construction zones, pot holes, unpaved roads, etc.). In the case of any unforeseen circumstances including, but not limited to, poor road conditions, car accidents, transportation issues, Acts of God, inclement weather, dropping of the cake, or any and all other causes beyond reasonable control that causes damage, KBT Treats will not be liable for more than the cost of the cake.
In situations where the weather conditions are extreme, we will put safety first and remain in constant communication with you. Together we will determine the best solution on an individual basis. Such a delay in pick up or delivery does not constitute grounds for a refund, discount, or store credit and KBT Treats will not be liable for any loss.
PHOTOGRAPHS I reserve the right to use any photographs I take of your order for promotion or display without any compensation to you.
DISCLAIMER Accepting these policies and making payment establishes a legally binding agreement between you and KBT Treats.
